Our mediation program, called Mediation Source, is a practical resource for real estate agents, buyers, sellers, and consumers who need cost-effective and speedy resolutions for ordinary disputes that do not need to go to court.

What Are The Costs?

Most general practice matters are billed to the client at an hourly rate depending upon the amount of time spent on the client's behalf. Some matters are billed at a "flat rate" fee. Examples of such services include: wills and estate planning; preparation of legal documents, such as an antenuptial agreement or setting up an LLC.

The initial conference with an attorney is billed at the hourly rate and is payable at the time the service is rendered whether the client chooses to retain the law firm or is merely seeking an opinion on a one-time basis.

Clients who are involved in cases that are ongoing will be asked to pay a retainer and to sign a retainer agreement. The retainer is an advance deposit that is held in the firm trust account and is only depleted as fees are earned. Any unused portion of the retainer is returned to the client when the case is completed.

Referrals of clients from M|H|S affiliated businesses, real estate agents, lenders, and builders are important. The individual who expects to be the actual client should contact the General Litigation Division directly so that the potential matter can be reviewed by a litigation attorney on its merits as well as the potential for conflicts if the case becomes adversarial.

In the initial conference, the litigation attorney will clarify his or her role, provide an estimate of time and costs, and discuss possible outcomes as well as an assessment of the client's expectations.
